A preliminary hearing in the case of the Metropolitan Police, which is facing health and safety allegations over the death of Jean Charles de Menezes, is to be held at the Old Bailey.

Mr de Menezes, 27, a Brazilian electrician, was shot dead at Stockwell Underground station, south London, in July last year by anti-terrorist officers who mistakenly feared that he was a suicide bomber.

The Metropolitan Police are being prosecuted under health and safety laws over alleged "operational errors" in planning and communication which fell short of criminal offences.

Mr de Menezes was put under surveillance on the morning of July 22 last year by police hunting men who had allegedly tried unsuccessfully to set off bombs on Tube trains and buses the day before.
